Service Agreement for Transported Semen
This
agreement is made this_________day of __________, 2006 , between
______________________(“Mare Owner”) and Bohlman
Quarter
Horses (“The Breeder”), for one breeding for (mare
name)___________________________________________________________,
Registration
number _________________________(the “Mare”) by cooled transported semen to
the
Stallion
Rock On Tari_ for the 2006
season
at
___$0____ (the “Stud
Fee”), live foal guarantee.
This
agreement is subject to the following terms and conditions:
1 Fees and Expenses:
Charges:
A
Non-refundable booking fee of $150.00 for reserving the Stallion is due together with this signed
agreement.
The Mare Owner agrees to pay all additional fees
including Fed Ex, container rental fee, and chute fee at least 1 week prior to
shipping.
Stud Fee: $200
Cooled Semen Expenses: 1st shipment of semen will have a $0 Chute Fee . Additional Shipments will be as follows: 2nd shipment $150 & any & all additional shipments will be $250 per collection. Collections will be made by Nancy Bohlman. Whenever possible each shipment will have enough semen for 2 inseminations. A sperm count will not be available. Mare owner has the option to request a vet collection for an additional $200 fee per collection.
Fed
Ex: Mare
owners will pay all Fed Ex Fees in advance or use their own account.
Container: The Mare Owner understands that the containers are the property of the stallion owner and will be returned to the stallion owner at the mare owners expense. Disposable containers may be returned by USPS. Mare owner agrees to pay a $50 Deposit per container. Deposit to be returned when mare is pronounced pregnant provided the contaiener has been returned . Containers must be returned within 10 days or deposit will be forfeited .
Billing:
Bills are
due and payable in full on the first day of the month following receipt of the
statement. Any balance
remaining unpaid after thirty days from the billing date shall bear interest at
the rate of 1.5% Per month from the
date billed on the date payment is received.

Conditions and Treatment:
A. The
Mare Owner represents and warrants to the Breeder that the Mare is in sound
breeding condition, is free from infection and diseases.
The Mare is registered with the American Quarter Horse Association
(“AQHA”) and that a copy of the Mare’s registration papers are attached to
this agreement. The Mare owner
further represents and warrants that it is the record owner of the Mare or has
an official lease of the mare.
B. The
responsibility for conception is on the Mare Owner. Therefore, a qualified, experienced licensed Veterinarian
competent in the use and handling of cooled and/or frozen semen should perform
the insemination. The Breeder, in
its sole discretion, may refuse to ship semen if the Breeder believes
insemination is not proper or the Mare is not healthy.
The Breeder reserves the right to request a
negative uterine culture and uterine biopsy performed prior to shipment
of semen if more than 2 breedings have taken place.

Waiver of Liability:
Other
than as provided in this agreement, the Breeder shall not be liable in any way
for any failure to settle injury, sickness, disease or death of the Mare arising
from the stallion service pursuant to this Agreement.

Breeding Season:
For
purposes of this agreement, unless otherwise specified for a particular
stallion, the breeding season Shall
begin March 1st and close June 20th of the year of this
agreement. Earlier and later
collections may be possible if arrangements are made in advance.

Cooled Semen Handling:
The
mare owner agrees to comply with all AQHA requirements, as applicable,
concerning the use and handling of cooled semen.
The Mare Owner agrees to perform the insemination within twenty-four (24) hours of receipt of the cooled semen.

Live Foal Guarantee:
The
Mare Owner is guaranteed one ”live foal”.
The term “live foal” means that the foal resulting from
the breeding shall stand and nurse for twenty-four (24) hours.
If a live foal does not result from the
breeding, the Mare Owner will be entitled to rebreed the Mare to the
Stallion for no additional Stud fee
during the same breeding season or the following breeding season, provided
proper written notification that the Mare has slipped or produced a non-viable
foal. The breeder may require that
the re-breeding be performed at an approved Veterinary facility and the Mare
Owner agrees to pay Mare care and other normal expenses relative to breeding.
$250 will be paid by the mare owner
per shipment of semen in addition to the fed ex fees.
All fees to be paid prior to shipping semen.
9.
Disclaimer:
Breeder
makes no representations or warranties, express or implied, regarding the cooled
and/or Frozen semen delivered
under this agreement, including, without limitation, representations or
Warranties that the cooled or frozen semen will safely reach the
insemination point without losing its integrity, quality or other
characteristics. The Mare Owner
acknowledges that the use of cooled and
frozen semen are emerging technologies that the Breeder cannot guarantee
in any respect. Breeder makes
no representations or warranties, express or implied, regarding the delivery of
the cooled and/or
frozen semen delivered under this agreement, and shall not be responsible for
delayed, lost or mishandled
deliveries. Semen will be collected
only on established breeding days and no
representations or warranties are made or implied that cooled or frozen
semen will be available at the time requested by the Mare Owner, even though
every attempt will be made to accommodate the mare owner.
9.
Breeder’s Certificate:
A
breeder’s certificate will be issued to the Mare 0wner after all fees and
expenses have been paid in
full and upon notification of the birth of the foal.
9.
General Terms:
In
the event that the stallion dies or becomes unfit for service, or in the event
that the Mare dies during the breeding season, the Mare Owner may substitute
another mare or breed the Mare to another stallion at the breeder’s farm. This agreement, when signed by the Mare Owner and the Breeder
and accompanied by payment of the booking fee, shall be a binding agreement on
both parties on the above terms and conditions.
This agreement constitutes the entire agreement between the parties
concerning the breeding of the Mare and the Stallion and supersedes all other
agreements or understandings between the parties.
This agreement may be executed in any number of counterparts which, taken
together, shall be considered as a single agreement.

Tips on how to have a successful experience.
1) Pay all fees prior to needing semen shipped. (every shipment)
2)
A
Pay Pal account makes it easy to transfer money quickly in the case of rebreeds.
3) Set up your own Fed Ex account so you will be billed directly for shipping charges or pay - Fed Ex fees must be paid prior to each shipment if using Bohlmans Fed Ex account.
4)
Keep
the stallion owner updated on the progress of ovulation, foaling dates etc. of
the mare.
5)
Hire
a vet that has a high % of successful pregnancies from shipped semen.
6)
Foal
Heats have the highest % of failed pregnancies.
Normal
shipping days will be Tuesday and Thursdays. Special arrangements will need to
be made for any other day.
Pickup
by Fed Ex is at 12:00 Noon.
I require a minimum of 48 hours notice for shipping semen.
To
make this process easier please keep me updated on the progress of the mares
cycle.
Inform
me when the mare foals (if she is foaling) and when the vet first starts
checking the mare for ovulation date. Please let me know the anticipated date
& keep me posted so I can plan
collections and make shipping arrangements.
